1. Acceptance of Terms
These Web Terms of Use ("Terms") form a binding agreement between you and Peachy Technologies ("Peachy," "we," "us"). They govern your access to and use of the websites, web tools, accounts, and Peachy Pro subscriptions offered at peachytechnologies.com (collectively, the "Service").
By accessing the Service, creating an account, or subscribing to a paid plan, you agree to be bound by these Terms and by our Web Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility & Accounts
You must be at least 13 years old to use the Service (16 in the European Economic Area / United Kingdom). If you are under the age of majority in your jurisdiction, you must use the Service with the involvement of a parent or legal guardian who agrees to be bound by these Terms.
You are responsible for keeping your account credentials secure, for all activity under your account, and for ensuring the information you provide is accurate. You may not share your account or transfer it to anyone else.
3. License to Use the Service
Subject to your compliance with these Terms, Peachy grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, or for legitimate internal business use if you have a Peachy Pro plan that permits it.
You may not (and may not allow others to): copy, modify, distribute, sell, lease, rent, sublicense, reverse engineer, or create derivative works of the Service or any portion of it; use the Service to build a competing product; or remove any proprietary notices.
4. Subscriptions, Billing & Auto-Renewal
4.1 Free and Paid Plans
Many Peachy tools are free to use. Peachy Pro is a paid subscription that unlocks additional features (such as larger character allowances for the Neural Text Reader and Pro-only sections of certain tools). Current pricing is shown on our Pricing page.
4.2 Payment Processor
Web subscriptions are processed by Stripe, Inc. By subscribing you also agree to Stripe's terms. Your payment method will be charged the displayed price plus any applicable taxes.
4.3 Auto-Renewal
Subscriptions automatically renew at the end of each billing period (monthly or yearly, as selected) at the then-current price unless you cancel at least 24 hours before renewal. You authorize us (and Stripe) to charge your payment method on each renewal.
4.4 Free Trials
If we offer a free trial, your subscription will begin and your payment method will be charged at the end of the trial unless you cancel before it ends.
4.5 Price Changes
We may change subscription prices. We will notify you in advance, and any change will apply to your next renewal — never retroactively.
5. Refunds & Cancellation
You can cancel your subscription at any time from your Account Settings. Cancellation stops future renewals; access to paid features continues through the end of the period you have already paid for.
Except where required by law, payments are non-refundable. We may, at our discretion, grant refunds for billing errors or extraordinary circumstances. To request a refund, contact [email protected].
6. Acceptable Use
You agree not to use the Service to:
- Violate any law or the rights of others;
- Upload or transmit content that is unlawful, infringing, defamatory, harassing, hateful, sexually explicit involving minors, or otherwise harmful;
- Send spam or unsolicited communications, or impersonate any person or entity;
- Distribute viruses, malware, or other harmful code;
- Probe, scan, or test the vulnerability of the Service or breach security or authentication measures;
- Use bots, scrapers, or other automated means to access the Service in a way that imposes an unreasonable load on our infrastructure;
- Resell, sublicense, or commercially exploit the Service except as expressly permitted; or
- Use the Service to develop a competing product.
7. User-Generated Content
Some Peachy tools let you upload, paste, or generate content (for example: shopping lists, files for the File Converter or Text Extractor, books or text for the Neural Text Reader, schedules for the Staff Scheduler). You retain ownership of your content.
You grant Peachy a limited, worldwide, royalty-free license to host, store, transmit, and process your content solely as necessary to operate the Service for you. We do not claim ownership and we do not use your uploaded files to train models.
You are solely responsible for your content and for ensuring you have the rights to upload it. Do not upload content that infringes intellectual property, privacy, or other rights of third parties.
8. Tool Output & No Professional Advice
- Health, fitness, and nutrition tools (meal planners, calorie calculator, how-many-calories) do not constitute medical, dietary, or professional advice. Consult a qualified professional before making health decisions.
- Financial tools (currency converter, crypto converter, Bitcoin price, USD to EUR, inflation calculator, gas calculator) are informational. Rates and prices are pulled from third-party feeds, may be delayed, and should not be used to make trading or investment decisions.
- Travel tools (flight tracker, rental car finder, weather) rely on third-party data that may be incomplete or out of date. Always verify with the operator before relying on the result.
You use any tool output at your own risk.
9. Intellectual Property
The Service, including all software, design, text, graphics, logos, and trademarks, is owned by Peachy Technologies or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers any ownership of the Service to you.
"Peachy," "PeachyList," and the Peachy logo are trademarks of Peachy Technologies. You may not use them without our prior written permission.
9.1 Feedback
If you send us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or attribution.
10. Third-Party Services & Data
The Service uses or integrates third-party providers, including but not limited to:
- Firebase / Google Cloud — authentication, hosting, Firestore, Cloud Functions;
- Stripe — payment processing;
- Google Cloud Text-to-Speech (WaveNet) and Microsoft Azure TTS — neural voices for the Reader;
- Spoonacular — recipe and meal data;
- Open-Meteo — weather data;
- USDA FoodData Central — nutrition data;
- Public exchange-rate, fuel-price, and flight-data providers as referenced on individual tool pages.
Third-party data is provided "as is." We are not responsible for the accuracy, completeness, or availability of third-party data, and we may swap or remove providers without notice.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. PEACHY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE OR RELIABLE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEACHY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID PEACHY IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $50.
13. Indemnification
You agree to defend, indemnify, and hold harmless Peachy and its affiliates from any claims, damages, costs, and expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your content.
14. Termination
You may stop using the Service at any time and delete your account from your Account Settings. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service.
Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.
15. Governing Law & Disputes
These Terms are governed by the laws of the jurisdiction in which Peachy Technologies is established, without regard to conflict-of-laws principles. The parties agree to exclusive jurisdiction in courts of that jurisdiction, except where mandatory consumer-protection laws of your residence apply.
You agree to first attempt to resolve any dispute informally by emailing [email protected] before filing a claim.
16. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date above shows when. If a change is material, we will provide reasonable notice (such as an email to your account address or an in-product notice) before it takes effect. Continued use of the Service after the effective date means you accept the updated Terms.
